JAMES PETERMAN ARTICLE of AGREEMENT with BENJAMIN PETERMAN

Nov. 1, 1821 Memorandum of agreement between JAMES PETERMAN of the one part and BENJAMIN PETERMAN of the other part is such that the said JAMES PETERMAN gives to the said BENJAMIN & his heirs, the upper equal half part of a tract of land conveyed to the said JAMES PETERMAN & his heirs &c. by Robert Montgomery lying & being in Sugarloaf Twp., Columbia Co. Penna., adjoining lands of HESS, SPENCER & others, this said tract of land deeded to said BENJAMIN & thence by said JAMES or his heirs, executors, administrators aforesaid, the said BENJAMIN to pay the taxes on the whole tract until otherwise disposed of the two parts on the Beaver Run to be divided between said BENJAMIN & the other half tract one falls off to each, given under my hand this day as above written JAMES PETERMAN.

N.B. In case that the said BENJAMIN PETERMAN should not obtain a deed for the above tract of land he is to be paid out of the said JAMES’ estate what three disinterested freeholders shall say is just after said James demese.

Columbia County, Penna.  Pesonally appeared in open court ALEXANDER COLLEY who being duly sworn according to law deposeth & saith that he was well acquainted with JAMES PETERMAN and has frequently seen him write and that the named JAMES PETERMAN signed the within agreement & further saith not. Columbia County SS: Personally appeared before the subscriber, one of the Justices of Peace in and for the said county CONRAD HESS who being sworn saith that he was well acquainted with JAMES PETERMAN and was present and saw the said JAMES PETERMAN sign the within Instrument & that the signature is the handwriting of the said JAMES PETERMAN          CONRAD HESS

Columbia County SS:  I John Russel Esq.  prothonatary of the Court of Common Please of Columbia County do hereby certify that the foregoing evidence of content central beween JAMES PETERMAN in his lifetime and BENJAMIN PETERMAN was exhibited at a Court of Common Pleas held at Danville on the 15th day of November 1826 A.D. & aknowledged by the said Court conforming to the Act of Assembly passed the 31st day of March 1792.   In testimony thereof I have hereunto set my hand and seal and affuxed the seal of the said Court of Danville Nov. 15, 1826 Pro. JAMES PETERMAN MEMORANDUM of AGREEMENT with ANDREW HESS

Memorandum of an Agreement between ANDREW HESS of the one part and JAMES PETERMAN

of the other part both of them of the township of Sugarloaf, Columbia County, Penna. of which the said JAMES PETERMAN agrees to sell to said ANDREW HESS a lot of land lying and being in said township and county and lying between Andrew Hess line and the banks of Beaver Run & to include said.

Hess claiming the same more or less at $4 per acre, lines to continue up Beaver Run so as to include the land.   JAMES PETERMAN

Appeared in open court ALEXANDER COLLEY who being duly sworn deposes and saith that he was well acquainted with JAMES PETERMAN who has signed the within instrument, that he saw him write and that he believes the signature JAMES PETERMAN to be the proper hand writing and signature of the said JAMES.   ALEXANDER COLLEY

Sworn & subscribed. Aug. 10, 1826.  John Russel Prop. Columbia County deposeth and saith that he was well acquainted with JAMES PETERMAN who has signed the within instrument that he has frequently seen him write, and that he believes the signature JAMES PETERMAN to be the proper handwriting and signature of the said JAMES.

 

BENJAMIN PETERMAN being sworn and subscribed  in open court Aug. 10, 1826 John Russel Columbia County aforesaid, I John Russel prothonotary to Court of Common Pleas of said county do hereby certify that the foregoing evidence of contract between JAMES PETERMAN in his lifetime and

MEMORANDUM of TITLE of this described piece of land which is part of a larger tract of land which was granted by Act of Assembly of Commonwealth passed March 31, 1792 to ROBERT MONTGOMERY by PATENT dated Feb. 15, 1816  was conveyed to JAMES PETERMAN in part V12, 132 acres 96 perches and all by deed dated July 3, 1816, recorded  in Book B page 287 and 289, Columbia County, Pennsylvania. DEED  ROBERT MONTGOMERY conveyed to JAMES PETERMAN

Before me WILLIAM MONTGOMERY and HANNAH his wife  of Mohoney Township, Columbia County, Penna for and in consideration of an indenture formerly to have conveyed the same and for the consideration of 5 shillings to us in hand paid by ROBERT MONTGOMERY of the town of Poland, Trumbald County, Ohio, have granted, bargained and sold by them do grant, bargan and sell to said

ROBERT MONTGOMERY his heirs and assigns a certain piece of about 8 Acres of land be the same more or less situated in the township of Greenwood and Derry, the said County of Columbia. Beginning at a pine  or corner in the Deartion between my lands and that place and lands formerly conveyed to said ROBERT MONTGOMERY about  80 perches from southern boundary of my lands at the south 26 degees east to the southern boundary of my land at that place then easterly along same to corner hemlock on bank of Little Fishing Creek thence to beginning  Together with all the rights of privileges therein to pertaining or in any way belonging to have and to hold to him the said Robert Montgomery, his heirs and assigns   WILLIAM  MONTGOMERY (seal) HANNAH MONTGOMERY (seal)

Note: William Bartleson Peterman was a small child when his father died intestate. His stepmother, Ann Batcheler-Bartleson-Peterman, widow of James Peterman, claimed she was unfairly cheated out of her home and 43 acres of land. When William Bartleson Peterman became an adult, he asked his stepmother to tell him the particulars of how she lost the land. At this time, Ann Peterman was living in Marshall, Michigan. Many letters passed between Ann and William. William Bartleson Peterman, through the Northumberland and Columbia County courts, sought justice. Some members of the Montgomery family who were the original owners of that particular tract of land were then living in Ohio, Missouri and Pennsylvania. It took several years from start to finish to prove an unjustice had been done. William Bartleson Peterman won the dispute. The following deeds address this issue.

DEED ROBERT MONTGOMERY to JAMES PETERMAN

This indenture made the third day of July A.D. 1816 between ROBERT MONTGOMERY of Cortsville in the county of Trumbull in the state of Ohio and LOUISE MARIA his wife of the one part and JAMES PETERMAN of Sugarloaf Township, County of Columbia, state of Pennsylvania of  the other part. ROBERT and LOUISE MARIA MONTGOMERY for and in considertion of the sum of $400 to them in hand paid by JAMES PETERMAN for land situate in Sugarloaf  township the receipt whereof is hereby acknowledged and said JAMES PETERMAN therefrom acquitted and forever discharged have granted bargained and sold and by these presents do grant, bargain & sell to said JAMES PETERMAN   all that certain piece of land situate in said township of Sugarloaf bounded as follows being part of a larger tract containing 463 Acres and 134 perches which was granted to said ROBERT MONTGOMERY by Patent bearing date of Feb. 15, 1816 A.D. beginnning at an old  marked white oak in western boundary of the larger tract pursuing the said original boundary north 15º east 170 perches to a post,  thence south 83º east 160 perches to a post, thence south 33º west 178 perches to a maple in the line of WILLIAM HESS  land, thence by line of same south 68º west 40 perches to a post, thence north 75º west 70 perches to place of beginning containing 145 acres and 2 perches of  land being the same more or less as afs. together with buildings, improvements, rights, privileges and appurtenances whatsoever therein pertaining or in any wise belonging.  To have and to hold to him the said JAMES PETERMAN his heirs and assigns forever to the only proper use & behoof of him the said JAMES PETERMAN his heirs and assigns afs.& further that the said ROBERT and LOUISE MARIE MONTGOMERY hath covenanted  & doth hereby covenant grant, bargain and agree for themselves, their heirs, executors, administrators and assigns to and with the said JAMES PETERMAN his heirs and assigns that they the said ROBERT and LOUISE MARIE MONTGOMERY that the whole of the land hereby granted or intended so to be with the appurtenances unto the said JAMES PETERMAN his heirs and assigns against them the said ROBERT and LOUISE MARIE MONTGOMERY,  their heirs, executors, administrators & assigns & against all manner of persons whosoever any thing thereon legally claimed or to claim by from or under them or any of them shall & will warrant & forever defend   In testimony thereof  the parties have hereunto set their hands and seals this day and year first above written ROBERT and LOUISE MARIE MONTGOMERY (seal) Signed, sealed and delivered in presence of George Tod and John Markey, state of Ohio, Trumbull County afs.  Be it remembered that on the 3rd day of July 1816 personally came before me the subscriber President Judge of the Court of Common Pleas in and for the 3rd Judicial District of the state of Ohio the within named ROBERT MONTGOMERY and LOUISE MARIE, wife of ROBERT personally acknowledged the same.   LOUISE MARIE being separate and apart from her husband the same to be their voluntary act and deed  In testimony thereof  I have hereunto officially subscribed my name at Gamptown, Trumball Co., Ohio in the 3rd Judicial District the day & year above written. This indenture made July 18, 1816 between ROBERT MONTGOMERY and LOUISA MARIE, his wife of the county of Trumbull, Ohio, of the one part and JAMES PETERMAN of Sugarloaf Twp., Columbia Co., Penna. of the other part to them in hand paid by said JAMES PETERMAN the consideration of the sum of  $400, a certain piece of land situate in said township of Sugarloaf  

Bounded and part of a larger tract containing 463 Acres and 134 perches which was granted to said ROBERT MONTGOMERY by Patent bearmg date of Feb. 15, 1816 A.D.
