Will of Joseph Fike (1799-1879)

In the name of God Amen. I, Joseph Fike of Summit Township, County of Somerset and State of Pennsylvania, being of sound mind and memory and considering the uncertainty of this frail and transition life do therefore make, publish and declare this to be my last Will and Testament.
First, after all my debts are paid and discharged the remainder of my estate real and personal shall be sold by my Executors herein named and the proceeds of which shall be divided equally among my children or their heirs as follows to wit:

My son Elias Fike has received at this date $926.49. My daughter Susan has received at this date $926.49. My son Samuel R. Fike has received at this date $926.49.My daughter Anna has received at this date $926.49. My daughter Catherine has received at this date $951.49. My son John M. has received at this date $1,448.83. My son Cyrus J. has received at this date $926.49. My son Jonas has received at this date $1,006.49. My son Daniel M. has received at this date $926.49. My son Mahlon has received at this date $926.49.

Now it is my will that my daughter Susan and my sons John M. and Jonas who have received more than the others of my children that they shall not receive any of the proceeds accruing from the sale of my real and personal estate until all of my children have received equal amounts.
Should one of the Executors die or move away then the other shall appoint another in his stead. Likewise, I make and appoint my son Elias Fike and Charles Griffith to be my Executors of this my last Will and Testament hereby revoking all former wills by me made.
In witness whereof I have hereunto subscribed my name and affixed my seal this the 5th day of August in the year or our Lord one thousand eight hundred and seventy eight.

On this 25th day of September A.D. 1879 before me William B. Frease Register for the probate of wills and granting letters of administration in and for County aforesaid personally came W. C. Hicks and C. A. Diveley the subscribing witnesses to the will hereto attached who have been duly sworn according to law do say that they were present and saw and heard Joseph Fike the testator sign and publish, pronounce and declare the foregoing statement as and for his last will and testament and that at the time of its drawing he was of sound mind, memory and understanding to the best of their knowledge and belief.
