Last Will and Testament of Gabriel Kline

Colebrookdale Township, Berks County, PA

In the name of God Amen, I Gabriel Kline of Colebrookdale Township in the County of Berks and State of Pennsylvania Yeoman, being sick and weak in Body but of sound mind, memory, and understanding (Blessed be God for the same) but considering the uncertainty of his transitory life do make and publish this my last will and Testament, in manner and form following to wit

Principally and first of all I command my immortal Soul into the hands of God who give it, and my Body to the Earth to be buried in a Christianlike and decent manner at the discretion of my Executors hereinafter named, and as to such worldly Estate, wherewith it has pleased God to bless me in this life, I give and dispose of the same in the following manner

First it is my will, and I do order, that all my Just debts and funeral expences be duly paid and satisfied, as soon as Conveniently can be, after my decease.

Item it is my Will and I do hereby order and direct, that my beloved wife Maria, is to have the sole use and Occupancy of all my real Estate, durining her life time, to be kept in customary repairs and the annual Taxes paid by my hereinafter named Executors, also to have in use such and so much of my Household goods and Kitchen Furniture she may see proper to keep during her lifetime, and after her decease the same to be equally divided, amongst my three children or to their Legal representatives, namely, Anna Margaret, now Widow of Jacob Roth deceased, Catharine, now the Wife of Ludwig Wean, Maria now the wife of Henry Geyer, also shall have in use for the said period one Horse and two Cows of my Stock likewise the annual Interest of Four hundred pounds lawfull money of Pennsylvania, and so much in money suficient for her support for the first year after my decease

Item I do here by give devise and bequeathe, unto my grandson Christian Schaner, Born of my Daughter Catharine, all and singular my real Estate, situate wheresoever, with the appurtenances thereunto belonging or in any wise appertaining and to receive Possession of the same, after the decease of my said Wife Maria, To hold the same to him the said Christian Schaner his Heirs and Assigns forever, Subject nevertheless to the payment of Four hundred and fifty Pounds lawfull money of Pennsylvania the sum of Fifty pounds thereof one year after the decease of my said wife Maria and the like sum of Fifty pounds yearly, untill the whole sum is paid without Interest and to be paid to my Executors hereinafter named, also devise unto him the said Christian Schaner a Compleat Bed, with coverlet, a Silver Watch, and a fowling Gun, to be delivered unto him after my decease and also the Stove in the front room of my dweling house to be delivered unto him after the decease of my said Wife Maria.

Item it is my Will and I do hereby order and direct that all the rest and residue of my Estate not herein otherwise directed shall be divided into three equal parts, the one share shall be put on Interest for the use and behoof of my said Daughter Anna Margaret during her lifetime and after her decease the Principal, to be equally divided to and amongst her Children begotten by Jacob Roth deceased.

One other Share to be put on Interest for the use of said Daughter Catharine during her life time, Excepting that the sum of Fifty pounds thereof to be paid absolutely unto her, and that one year after my decease And after her decease the Principal to be equally divided to and amongst her Children also Excepted the sum of seventy five pounds thereof to be paid unto my grandson Christian Schaner one year after my decease.

And one other and last share to be absolutely paid unto my Daughter Maria, or to her legal representatives

To hold the same to the several legatees and their Heirs respectively forever

Item It is my especial Will and desire that if any of my Heirs or their representatives shall in any wise commence a dispute or lawsuit not absolutely necessary, that all Costs Trouble and expences to be bore and paid out of the Share, who may Commence such suit or other disputes

And lastly, I nominate, Constitute and appoint my son in Law Henry Geyer of Douglass Township in the County of Montgomery and my friend Jacob Stauffer (Abrahams son) of Colebrookdale Township aforesaid, to be my Executors, of this my Will hereby revoking all other Wills, Legacies and bequeste by me heretofore made and declaring this and no other to be my last Will and Testament.

In Witness whereof I have hereunto set my hand and Seal this third day of April in the year of our Lord One thousand eight hundred and nineteen.

Registers office Reading Berks County May 18th 1819 Then appeared Johannes Sweinhart and John Stauffer, Witnesses to the afore Writen Will Who were duly qualified according to Law did depose and say that they where present and did See and hear ---- See the testator Sign publish Pronounce and declare this Instrument of Writing as and for his last Will and Testament; and further at the time of the doing thereof he was of sound mind memory and understanding to the best of their knowledge and as the verily bleive And further that the names Johannes Schwinhart and John Stauffer are of deponants own hand writing thereto Subscribed as Witnesses in the presents of each other and in the presents and at the particular Request of the Testator ~~~~~
