Last Will and Testament of Samuel Heckman

Kutztown 1871

I Samuel Heckman of the Borough of Kutztown in the County of Berks and State of Pennsylvania being of sound mind and memory and understanding do make and publish this my last will and testament hereby revoking and making void all former wills by me at anytime heretofore made.

And first I direct that my body be decently interred in the Fairview Cemetery in Maxatawny according to the rites and ceremonies of the Lutheran Church and that my funeral be conducted in a manner corresponding with my estate and situation in life and such estate as it has pleased God to entrust me with. I dispose of the same as follows viz.

Item I give and bequeath to my son Newton Heckman and my daughter Matilda Heckman all my household furniture including carpets, bedding, etc. in my dwelling house and also two hundred dollars in money to be paid to my daughter Matilda Heckman by my executor herein named as soon after my decease as can be conveniently with a proper settlement of all my debts and to have and to hold the same to her heirs and assigns forever.

I also give devise and bequeath to my son Newton Heckman the lot of ground on which my Cigar Manufactory is situated, adjoining my dwelling house situated on main street in said borough of Kutztown containing twenty five front and three hundred and twenty five deep and all that piece or pieces of land situated in said borough on Whiteoak Street bounded by other lots of Henry Biehl, Sarah Neff and Anna Weidner for which two described lots. My son Newton Heckman shall pay to my executor herein named the sum of six hundred dollars.

Item all the rest and residue of my real and personal estate whatsoever and where so ever of what nature kind and quality so ever the same may be and not-herein before given and disposed of shall by my executor be sold at public sale, and after paying my debts and legacies and funeral expenses, I give and bequeath unto my five children namely Ozias N Heckman, Sarah Heckman now intermarried to Augustus Sander, Newton Heckman, Matilda Heckman and Silas Heckman, share and share alike.

And I do hereby constitute and appoint my said son Newton Heckman executor of this my last will and testament, and for which services he shall be paid the sum of fifty dollars.

In witness whereof I Samuel Heckman the testator have to this my will written on one sheet of paper set my hand and seal this twentieth day of February A.D. one thousand eight hundred and sixty nine.

Signed Sealed published and declared by the above named Samuel Heckman as and for his last will and testament in the presence of us who have hereunto subscribed our names at his request as witnesses thereto in the presence of the said testator and of each other.

On the 5th day of July before me H S Getz Register of wills did personally appear D B Snyder & A S Hottenstein the subscribing witnesses to the foregoing will being duly sworn according to law did dispose and say that they were present and did see and hear Samuel Heckman the testator sign, seal, publish and declare the foregoing instrument of writing as and for his last will and testament that at the time of so doing he was of sound mind memory and understanding to the best of their knowledge observation and belief.
