Last Will and Testament of Peter Umstead

Proved: 17 February 1835

In the name of God Amen I Peter Umstead of union Township in the County of Berks and State of Pennsylvania, yeoman Being in a poor State of health and considering the uncertainty of this transitory life, But at the same time of sound mind memory and good understanding and Blessed Be the almighty God for the same, and do make and publish this my last will and Testament in manner and form following, to Wit:

First it is my will and I do order that all my just debts and funeral expense be duly paid out of my Estate as soon as conveniently after my death by my executors herein after named and appointed.

Item – I give and bequeath unto my beloved wife Elizabeth Umstead so much of my household and kitchen furniture as She may choose to take and the remainder of my personal estate and all my real Estate I direct my executors to Sell at a public Sale as soon as convenient for the best price they can get and make a good title to the purchaser thereof as good as I myself could do to be valued good in the Law and out of the money arising out of the Sale of my real and personal Estate I give and devise the same as follows Viz:

Item – I give and bequeath unto my Dear wife Elizabeth the interest of one Thousand Dollars to be paid to her anually during her lifetime, the principle to be secured in my real Estate and in case the Interest of the one thousand Dollars Should not be sufficient for her support, She Shall have of the principle Sum as much as she may want if she remains my widow.

Item – I give and bequeath unto my Grandson Elhanen Sidle one hundred Dollars to be paid to him.

Item – I give unto my Granddaughter Edith Lapsly one hundred dollars to be paid to her, and the remainder of the proseads of my Estate I give and bequeath unto my six daughters in equal Shares namely as follows:

One Sixth Shair to be paid to Jacob Bunn intermarried to my Daughter Mary now deceased, one Sixth Share to be paid to my Daughter Hannah intermarried with John Lewis to be paid to her and one Sixth Share to my Daughter Lidia intermarried to George Wert one Sixth Shair to my Daughter Elizabeth intermarried to Jacob Wanger one Sixth Share to my Daughter Sarah married to William Bland and one Sixth Share I give and bequeath unto my Daughter Rebeca Lapsly widow of Samuel Lapsly deceased, that is to say the principle of her Sixth Share to be invested in same real Estate the Interest thereof to be paid to her the said Rebeca during her lifetime in case She Should stand in acual need She may consume of the principle also and the instrument to be made of her share is to be at her disposal at all times forever and for her use only and Lastly I nominate and appoint Frederick Linderman to be the executors of this my Last will and testament hereby renouncing all former wills by me made and Declaring this to be my Last will and Testament. In Witness whereof I have hereunto set my hand and seal this the twenty fifth day of November one thousand eight hundred and thirty four.

On the 17th day of February A.Dom. 1835 Then appeared Henry Wamsher and David Wamsher and being duly qualified according to Law did depose and say that they were present and saw and heard the Testator sign, seal, publish, pronounce and declare the foregoing instrument of writing, as and for his last will and Testament, and that at the time of the doing thereof, he was of sound mind, memory and understanding to the best of their Knowledge, observation and belief.

We the heirs and legatees of Peter Umstead of Union Township Berks County hereby agree that we are satisfied with the account of Frederick Linderman Esq. Executor of the last will of the said Peter Umstead and respectfully request that the same may be confirmed by the court.
