Last Will and Testament of John Daniel Delp

In the name of God Amen.

I John Daniel Delp of Alsace Township, Berks County and State of Pennsylvania, Yeoman, I am weak in body, but of sound mind, memory, and understanding, do make and publish this my Last Will and Testament hereby revoking and making void all former wills by me at any time heretofore made.

And First I direct that my body be decently interred in a Christian like manner according to the rites and ceremonies of the Lutheran or Reformed Church and that my funeral be conducted in a manner corresponding with my estate and situation in Life.

As to such estate as it hath pleased God to entrust me with I depose of the same as follows to viz:

My worldly things consisting of three tracts of land situate in Alsace Township, County and State aforesaid containing together twenty nine acres more or less and different personal property. I give and bequeath my real and personal property to my beloved wife Polly during her natural life, or as long as she remain my widow, with the subjecting of the house and lot of ground here I now reside containing four acres more or less which shall be sold by my hereinafter named executors on public or private sale for the purpose of paying my debts and to give deed of conveyance for the same, and if the same should insufficient to pay all my debts, the hereinafter named Executors shall have the Privilege to cut of the wood or so much thereof to satisfy the same or as they may think proper but my dear wife shall see that the taxes will be punctually paid and the building and fences kept in repair.

Item and after the death of my dear wife Polly, I do order that my hereinafter named executor to sell all my Real and Personal property on public sale and the money arising thereof after all cost be paid and divide the remainder amongst my six children in shares and share alike to be as follows, to my four sons Daniel, Samuel, Franklin and James with the exception that my three sons Daniel, Franklin, and James the said shares shall not be paid into their hands but their shares to their children forever and to my two daughters Sarah intermarried to William Feather and Mary intermarried to Justinus Kline.

Item, it is my will that my just debts be duly paid and satisfied as soon as conveniently be after my decease and also my funeral expenses.

And lastly I do constitute and appoint my dear wife Polly and my esteemed friend J. Phillip Herline to be the Executors of this my last Will and Testament.

In witness whereof I John Daniel Delp the Testator have to my Will written on one sheet of Paper set my hand and seal at Alsace this Thirtieth day of December A.D. one thousand and eight hundred and eighty one. (Dec. 30th 1881)

Registers Office Berks County SS on the 3rd day of February A.D. 1882. Before me P.Y. Edelman Dep. Register of Wills, personally appeared Justus Kline and James Herline, the subscribing witnesses to the foregoing will being all duly sworn according to law did depose and say that they were present and did see and hear the testator John Daniel Delp sign, seal, publish and declare the foregoing instrument of writing as and for his last will and testament, that as the times of so doing he was of sound mind memory and understanding to the best of their knowledge observation and belief.
