1830 - 1835 Orphans Court Hearings and Dispsition of Lands: John Christ, deceased

The Commonwealth of Pennsylvania (unreadable several words) presents shall come. Greeting ... Know Ye that amongst the (unreadable) proceedings of the Orphans Court of the county of Berks before the Honorable Robert Porter Esquire, President, and Mathias L. Richards and William Darling Esquires of the said Court (unreadable) It is thus contained at an Orphans Court held at Reading (unreadable) the county of Berks, the fifth day of November in the year of our Lord one thousand eight hundred and theiry before Robert Porterm Mathias S. Richards and William Darling Esquires, justices of the said County, Upon the petition of John Christ, eldest son and heir at law(?) of John CHrist late of the Township of Bern in said County, Yeoman, deceased (unreadable) froth that the said John Christ died intestate about nine years ago leaving a widow named Margaret who is satill in full life and issue eight children to wit - your petitioner who is of full age, Daniel Christ of whom Werner Kline is Guardian, Jacob Christ, Polly Christ and Benjamin Christ of whom John Christ is Guardian and Hetty Christ Elizabeth Christ and David Christ of whom John Buck is Guardian The last seven named Children being in their minorities That the said Intestate at the time of his decease was seized in his demesne as of fee of and in a Certain Messuage tenement and tract of land containing one hundred and thirty six acres and one hundred and fifty two perches [or thereabouts] with the appurtenances situate in the township of Bern and County aforesaid adjoining lands of John Bright, John Bucks, John Haas, John Christ and others of and in Certain Tract of Wood land containing two acres and Seventy six perches by the same more or less situate in Upper Bern Township and County aforesaid bounded by lands of Nicholas Lafs (?) Christian Albright Albright Strause and others. AND therefore praying the Court to award an inquest to make partition of the same Messuage Tenement and Tract of Land with the appurtenances to and among the Children and Representatives of the said Estate in such manner and in such proportions as by the laws of this Commonwealth is directed if such partition can be made without prejudice to and spoiling the whole but if such partitions cannot be made thereof as aforesaid then to Value and Apprais the same and make report of their proceedings herein according to law The Court here do award an inquest to make partition of the Real Estate in the said partition mentioned whereof the same John Christ the intestate therein named died seized to and among the Children and representatives of the said intestate in such manner and in such proportions as by the Laws of this Commonwealth is directed and appointed as such partition can be made without prejudice to and spoiling the whole otherwise to Value and Appraise the same And it is further ordered by the Court that a writ issue too the Sheriff Commanding him to Summon an inquest for the purpose aforesaid returnable before the Justice of this Court the seventh day of January next and the same writ issues accordingly -- Afterwards to wit at an Orphans Court held at Reading the seventh day of January in the year of our Lord one thousand eight hundred and thirty one before Robert Porter Matthias S. Richards and William Darling Esquires Justices of said Court. James Sillyman Junior Esquire High Sheriff of Berks County made return of the said writ in words following viz. To the Justices within named I do hereby Certify that the execution of the within writ appears by the Schedule hereinto annexed So answer James Sillyman Jr. (?) Sheriff Inquisition indented and taken at the late dwelling of John Christ deceased in the Township of Bern in the County of Berks the twenty fourth day of November in the Year of our Lord one thousand eight hundred and thirty before James Sillyman Jr. Esquire High Sheriff of the County aforesaid by Virtue of a writ of partition or Valuation to him directed and to his inquisition annexed by the oaths of Adam Kalbach Adam Dundore Jacob Moyer Peter Kerchner John Grime Adam Bohn Thomas Almpehacker Jacob Hoffman Henry Hettinger John Conrad John Dundoor and Conrad Reber twelve free honest and lawful men of his bailiwick who on ...?....?...?...? they went to and upon the ...?...?...?....?...? the intestate in the same ...? ...? ....? ...? same could not be parted and divided to and among ...? ...? ...? ...? named without prejudice to and spoiling the whole ...? ...? ...? ...? oaths and affirmations aforesaid do further find that the ...? ...? ...? ...? accommodate two of the Children of the said intestate that is to say ...? ...? ...? Messuage Tenement and Tract of land situate in Bern Township in the County aforesaid bounded by lands of John Bright John Bucks John Christ and others ...? Containing one hundred and thirty six acres and one hundred and fifty (?) perches or thereabouts would Conveniently accommodate one of the parties in the said ...?...?...? the Inquest aforesaid on their oaths aforesaid respectively do say that certain tract of piece of wood land being the second in the said writ mentioned situate in Upper Bern Township in the County aforesaid bounded by land of Nicholas Las late Christian Albright, Albright Atrause and Containing two acres and seventy six perches more or less would conveniently accommodate one other of the parties in the said writ named And the inquest aforesaid on their oaths aforesaid do Value and apprais the same at the sum of Forty eight dollars lawful money of Pennsylvania In Testimony whereof as will the said Sheriff as the Inquest aforesaid to this Inquisition have hereunto interchangeably set their hands and seals dated the day and year first above written Adam Kalbach (seal) Adam Dundor (seal) Jacob Moyer (seal) Peter Kirsher (seal) John Grim (seal) Adam Bohn (seal) Thomas Umberhocher (seal) Jacob Kaufman (seal) Henry Hettinger (seal) John Conrad (seal) John Dundor (seal) Conrad Reber (seal) James Sillyman Jr., Sheriff (seal) Whereupon the said proceedings were confirmed by the Court afterwards to wit at an Orphans Court held at Reading in and for the County of Berks on the sixth day of August A.D. One thousand eight hundred and thirty one before the Honorable Garrick Mallery Esquire President and Matthias S. Richards and William Darling Esquires Advocate Judges of the said Court John Christ the eldest son of the intestate appearing in Court and made choice of purpart No 1 valued at one thousand six hundred and fifty dollars and the Court did judge the same to him accordingly and directed him to enter into recognizance and bound to secure the others Herein their respective shares with Interest from the first day of April next AND now to wit At an Orphans Court held at Reading in and for the County of Berks on the sixth day of April A.D. one thousand eight hundred and thirty two before the same Judges aforesaid Daniel Christ appeared in open court and Accepted purport No. 2 valued at forth eight dollars. The Court there award the same to him and directed the said Daniel Christ to enter into a recognizance ---.

...?...?...? by these presents that Daniel Christ ...? ...?...?....?...? of the sum of ninety nine dollars to him in hands...?...?...?of Upper Bern Township in the County of Berks and State of Pennsylvania...?...?...? before the ensealing and delivery hereof the receipt whereof is hereby...?...?...?...? have granted Bargained Sold Assigned and Set over and by these presents ...?...?...?...? grant Bargain Assign and set over unto the same Conrad Druwitz his heirs and assigns all that the within mentioned Messuage Peace or Tract of land containing two acres more of less Together with all and singular the Rights Members and Appurtenances whatsoever thereunto belonging or in anywise appertaining and the remains and remainders rests Issues and profits thereof To have and to hold the said Messuage Peace or tract of land hereby granted and assigned or mentioned or intended so to be with the appurtenances unto the same. Conrad Druwitz his heirs and assigns to the only proper use and be hoof of the same Conrad Druwitz his heirs and assigns forever. And the said Daniel Christ and his heirs the same hereby granted and assigned premises with the appurtenances and the said Conrad Druwitz his heirs and assigns against him the said Daniel Christ and his heirs and against all and every other person or persons whomsoever lawful Claiming or to Claim by from or under his them or any of them shall and will Warrant and forever defend by these presents in Messuage whereof the said Daniel Christ hath herewith set his hand and seal the twelfth day of April In the year of our Lord one thousand eight hundred and thirty four.

Be it known that on the 12th day of April A>D> 1843 Before me Jacob Miesse Esquire one of the Justices of the Peace in and for said County came the above named Daniel Christ and acknowledged the above written Indenture of Assignment to be his act and Deed and desired that the sum might be recorded as such according to Law. In testimony whereof I have hereunto set my hand and seal the day and year above written.
