Estate Record of Johan Heinrich Clevenstein (1749-1805)

The Commonwealth of Pennsylvania to the Sheriff of Berks County, Greetings:

Whereas George Clevenstein eldest son of Henry Clevenstein late of the Township of Robeson in the said County of Berks yeoman deceased preferred a petition to our Judge of the Orphans Court of the said County, setting forth that his said Father died intestate about for months ago leaving a widow named Sarah, issue of thirteen children/ to wit/ your petitioner, Margaret wife of John Steyer, Mary wife of Amos Beard, Henry, John, Elizabeth, Catharine, Christian, Michael, Hannah, Sarah, Daniel, and Molly, the nine last named are yet in their Minority. And that the said Intestate, died, seized in his demesne as a free of in the following lands, a mefsuage tenement of tract of land situate in Robeson Township, containing one hundred and ninety acres more or less adjoining the lands of Richard Jacobs, William Searlet, Michael Beard, and others. Also two tracts contiguous to each other on which there is a mefsuage erected. Situated in the Township . Afore containing in the (???le) one hundred and forty acres more or less, adjoining the lands of Peter Theiuer, Adam Wickham, John Bitler, Ruban Jacobs and others with appurtenances, and therefore praying the Court to award an inquest to make partition and Representatives of said Intestate, in such manner and in such proportions as by the laws of this Commonwealth is directed; in such partitions can be made without prejudice to or spoiling the whole: But if such partitions cannot be thereof made as aforesaid, then to value and appraise the same, and make a report of their proceedings according to law, and the said Inquest is awarded by the Court, according to the prayer of the said partitioner. We therefore command you, that taking with you twelve honest and lawful men of your bailiwick, you go to the said mefsuages and three tracts of land. And there by their oath or solemn affirmation in the presence of the parties aforesaid by you be warned, (?) upon being warned they will be present the said mefsuages and three tracts of land. With the appurtenances whereof the said Henry Clevenstein died, seized intestate, leaving respect to the true value thereof to and among the said parties, you cause to be parted and divided, if that partitions of divisions can be made without prejudice to or spoiling the whole thereof, and to each and every of the Children and Representatives of the said intestate, their respective shares therein according to law, to hold to them severalty, you assign and deliver, etc. But if the inquest cannot make such partitions of the said mefsuages and tracts of land with appurtenances without prejudice to or spoiling the whole there of, that then you cause the said Inquest to value and appraise the same. And that partition or valuation so made, you distinctly and openly have before our Judges at Reading at our Orphans Court, there to held the Fourth day of September next under your hand and seal and under the hands and seals of those by whose oath and affirmation you shall make such partitions or valuations, and have you then there this Writ: Witness the Honorable Jacob Rush, Esq. at Reading the First day of May in the year of our Lord one thousand eight hundred and five.
