The Last Will and Testament of Jeremiah Englehart

Be it Remembered

That I, Jeremiah M. Englehart, of Stony Creek Mills, Pennsylvania, being of sound and disposing mind, memory and understanding, and considering the uncertainty of life, do therefore make, publish and declare this to be my last Will and Testament, in manner and form following, that is to say:

First: I order all my just debts and funeral expenses to be paid by my Executor hereinafter named, as soon as conveniently may be after my decease.

Second -- I give, devise and bequeath unto my son Robert H. Englehart, the sum of $200.00 to have and to hold the same to his own use, absolutely and forever. This bequest being made in appreciation of his faithful services rendered me during my life time.

Third -- I give unto my son, Robert H. Englehart, the opportunity, right and privilege to purchase real property used as my home for the price of $800.00, if he so desires, this election to be made within a six (6) month period after my death. In the event that my son, Robert H. Englehart, should desire not to purchase my home, I do then order and direct that my Executor sell and dispose of said real estate, he hereby having authority and power to sell either at public or private sale and without order of Court, and to execute all deeds, transfers and conveyances necessary to vest in the purchaser or purchasers a fee simple or absolute title thereto.

Fourth -- All the rest residue and remainder of my estate, real, personal or mixed; of whatever nature and wheresoever situate, which I may own or have the right to dispose of at the time of my decease, I give, devise and bequeath unto my three (3) sons, Daniel H. Englehart, Jeremiah H. Englehart, and Robert H. Englehart, share and share alike, absolutely, he or they to have and to hold the same to his or their own use, absolutely and forever.

And lastly -- I do make, constitute and appoint my son, Robert H. Engelhart to be my Executor of this my last Will and Testament, hereby revoking all former Wills and Testaments by me at any time heretofore made, and declare this to be my last Will and Testament.

In witness whereof, I have hereunto subscribed my name, and affixed my seal, the 11th day of July in the year of our Lord one thousand nine hundred and thirty-two (1932)

Signed, sealed, published and declared by the testator above named, as and for his last Will and Testament, in the presence of us, who have hereunto, at his request, subscribed our names in his presence, and in the presence of each other, as witnesses hereto.
