Last Will and Testament of James Tyack

1874 Cumru Twp

I James Tyack of Cumru Township, Berks County, Pennsylvania being of sound mind memory and understanding do make and publish this my last will and testament.

First I direct that all my just debts and funeral expenses be paid as soon as conveniently can be after my decease.

Item I direct and desire that I be buried at the head of my children or somewhere near them in the Grave Yard at Yocum Church in Cumru Township and that a fitting tombstone be erected at the head of my grave.

Item I hereby authorize my hereafter named executor to sell, my house and lot of ground situate in Little Pine Street between Sixth and Seventh Streets in the City of Reading and numbered No. 647 containing in front fifteen feet and in depth one hundred and thirty feet, hereby authorizing him to give the purchaser or purchasers thereof a deed of conveyance in fee simple.

Item I hereby order and direct that so long as my beloved wife Grace Tyack desires to remain on the property which I now occupy she shall do so: but as soon as she shall remove thereupon. Or shall again be married then O hereby authorize my hereafter named Executor to sell the same, consisting of a tract of land in Cumru Township and containing eight acres more or less and I hereby authorize and empower my said executor to give the purchaser or purchasers there of a deed of conveyance on fee simple, subject to the reservations now existing. And while my said wife shall remain on said property she shall have all the personal property, which I shall on possiped(?) of which an inventory shall be taken at once. But if she remove there from or is again married, then I order my executor to make sale of the same and convert the same into money of my property real personal or mixed is converted into money aforesaid I order and direct that m beloved wife Grace Tyack shall have the benefit thereof as long as she lives and remains my widow. And to this end I hereby authorize my executor to pay her a sum not exceeding ten dollars a month of she shall (???) in need thereof.

Item if my said wife should die during her said widowhood, then I order my executor shall pay the expenses of her funeral out of my estate and shall erect a suitable tombstone at the head of her grave.

Item if my said wife should die or again marry before any or all of my said real estate or personal property is sold, then in either event I order and direct my said executor to sell the same or appraised and I order and direct that the proceeds thereof be divided to and among my children as follows: to my daughter Christina intermarried with John Mash, the one-third part thereof, to my daughter Emily Tyack one-third part thereof and to my daughter Grace intermarried with John Hoffert the one-third part thereof.

Lastly I do hereby constitute and appoint my friend Moses Yocum of Cumru Township Executor of this my last will and testament.
