Last Will and Testament of Jacob Yoder

In the name of God Amen.

I Jacob Joder of Rockland Township in the County of Berks and State of Pennsylvania, (Yeoman). Being weak in Body, but of Sound and Disposing Mind, Memory and Understanding; do make and Ordain this my last Will and Testament in manner and form following. Viz..

Imprimis, My will is that my body be decently buried, my funeral expenses and all my just debts paid out of my Estate by my Executors herein after named.

Item, I do order and direct that my plantation, where on I know live, with the appurtenances thereunto belonging shall be sold at public vendue or out cry, to the highest and best bider, as soon as convenient after my demise, and the money arising there from, together with all others my estate shall be divided among my children and grandchildren in manner following.

Item, I give and bequeath to my son Daniel Joder, his heirs and assigns forever, the one equal twelfth part of my estate, not herein before bequeathed or otherwise ordered and directed.

Item, I give and bequeath to my son Peter Joder, his heirs and assigns forever, the one equal twelfth part of my estate, so remaining as aforesaid.

Item, I give and bequeath to my son John Joder, his heirs and assigns forever, the one equal twelfth part of my estate, so remaining as aforesaid.

Item, I give and bequeath to my son Abraham Joder, his heirs and assigns forever, the one equal twelfth part of my estate, so remaining as aforesaid.

Item, I give and bequeath to my son Jacob Joder, his heirs and assigns forever, the one equal twelfth part of my estate, so remaining as aforesaid.

Item, I give and bequeath to my daughter Elizabeth Gruber, her heirs and assigns forever, the one equal twelfth part of my estate, so remaining as aforesaid.

Item, I give and bequeath to my daughter Catharine Angstadt, her heirs and assigns forever, the one equal twelfth part of my estate, so remaining as aforesaid.

Item, I give and bequeath to my daughter Magdalena Angstadt, her heirs and assigns forever, the one equal twelfth part of my estate, so remaining as aforesaid.

Item, I give and bequeath to my daughter Esther Barto, her heirs and assigns forever, the one equal twelfth part of my estate, so remaining as aforesaid.

Item, I give and bequeath to my daughter Mary Mensch, her heirs and assigns forever, the one equal twelfth part of my estate, so remaining as aforesaid.

Item, I give and bequeath to my grandchildren the issue of my daughter Susanna Heres, deceased, her heirs and assigns forever, the one equal twelfth part of my estate, not before bequeathed, the same to be equally divided among them share alike, to hold to them, their heirs and assigns for ever.

Item, I give and bequeath to my grandchildren the issue of my daughter Barbara Oyster, deceased, her heirs and assigns forever, the one equal twelfth part of my estate, not before bequeathed, the same to be equally divided among them share alike, to hold to them, their heirs and assigns for ever.

Item, And whereas I have advanced to several of my aforementioned children, sundry articles in Stock, cash, or otherwise, which stands charged in my book of accounts, my will is that each and every such charge be considered as part of each child’s equal share as twelfth part as before bequeathed avoiding the respective charges.

Lastly, I do hereby nominate, constitute and appoint my son Abraham Joder, and my son in law Abraham Angstadt, Executors of this my last Will and Testament. Hereby Revoking all former wills by me made, ratifying and confirming this, and no other to be my last Will and Testament, In Witness whereof I have hereunto set my Hand and Seal the Twelfth day of March, in the Year of our Lord One Thousand Eight Hundred and Three.

Signed, Sealed, Pronounced and Declared By the aforesaid Jacob Joder, to be his Last Will and Testament, in the presence Of us, who at his request and in his Presence have subscribed our names As witnesses Hereunto

Registers Office Reading in Berks County Mar 14 1804, there appeared Thomas Lee and Samuel Lobach the subscribing witnesses to the forgoing Will who duly affirmed according to Law did declare and say that they were present together and did see and hear Jacob Joder the Testator sign by making his mark, seal, publish, pronounce and declare the same writing as and for his last Will and testament and that at the time of the doing thereof the Testator was of sound mind, memory and understanding, to the best of their knowledge as they veridy believe, and further that the names Thomas Lee and Samuel Lobach are the witnesses own hand writing there to subscribed in the presence of each other, and in the presence and at the request of the testator.
