In the matter of Jacob Klee Sen., deceased – The undersigned having been selected(?) and summoned by the Administrators of the Estate of Jacob Klee, late of Centre Township, Berks County, deceased, to appraise the property retained by Maria Klee, widow of the said Jacob Klee, deceased, under the provisions of the 3rd Section of the Act of April 14th, 1851, and the several supplements to said Act, and having been respectively sworn do value and appraise the same as follows to wit:

The tract of cleared land situate in Centre and Lower Bern Township, Berks County, Rounded and describes as follows: Beginning at a post in a line of Michael Staudt land thence by the same. South ten degrees and a quarter east forty three perches to a stone thence south twenty nine degrees and a half west, three perches and six tenths thence. South twenty nine degrees and a half west three perches and six tenths thence by Daniel Dundors? land. North eighty four and a quarter degrees. West eighteen perches and five tenths to a hickory thence by Daniel Wanyanys? land. North ten and a quarter degrees west forty perches and four tenths to a stump. Chance? by other land of late Jacob Klee, deceased. North eighty degrees and three quarters. East nineteen perches and eight tenths to the place of beginning. The petition of William Seaman [Personal note: The name “Seaman” is misspelled as “Saeman” at times in this document. Upon research, it appears the correct spelling was “Seaman” officially], a minor child of Lewis Seaman and Polly Seaman, his wife, now deceased, by his father Lewis Seaman respectfully represents: That said William, a minor under the age of fourteen years, that there is coming to him a small legacy from his grandfather, Jacob Klee, dec'd (deceased), by right of his mother Polly Seaman, dec'd (deceased), and that he has no person legally authorized to take charge of his estate. He therefore, prays? the Court to appoint some suitable person his guardian for that purpose and suggests John S. Klee as a suitable person. The petition of Lewis Seaman and Catharina Seaman, minor children of Lewis Seaman and Polly, his wife, dec'd (deceased), above the age of fourteen years, respectfully represent that there is a small legacy coming to them from their grandfather, Jacob Klee, late of Centre Township, Berks County, dec'd, by right of their said mother Polly Seaman, dec'd, and that they have no person legally authorized to take charge of their estate. They, therefore, pray the Court to appoint a suitable person for their guardian for that purpose and suggest John S. Klee as a suitable person.

INQUISITION.

Indented and taken at the house of late Jacob Klee, Sen., dec'd in the township of Centre, in the County of Berks, the 21st day of May – in the year of our Lord, one thousand eight hundred and sixty – before Jeremiah D. Bitting, Esq., Sheriff of the county aforesaid, by virtue of a writ of Partition or valuation, to him directed, and to this Inquisition annexed by the oaths of Daniel Whiskeyman, Jacob Koch, Henry Phillips, William Potteiger, Frederick Yoder, Reuben Huff, Emmanuel Althouse, Levi F. Dietrich, George F. Loos, William Kauffman, William L. Loos, and Daniel Zerby – twelve free, honest and lawful men of you bailwick, who upon their oaths and affirmations aforesaid respectively, do say, that they went to the Message tenement and tract of land situate in Centre Township, Berks County, adjoining lands of Jacob Klee, Jr., Michael Staudt, and others, containing twenty four acres, more or less.

Whereof Jacob Klee, Sen., in the same writ named, died, seized, and then and there did find that the same could not parted and divided to and among the parties in the said writ named, without prejudice to, or spoiling the whole thereof; AND THEREFORE THE INQUEST aforesaid, on their oaths or affirmations as aforesaid, have valued and appraised the same at the sum of fourteen hundred and fourteen dollars.

In Testimony Whereof, as well the said Sheriff, as the Inquest aforesaid, have to this Inquisition interchangeably set their HANDS and SEALS.

Whereas, Jacob Klee Jr., of Centre Township in the County of Berks, one of the sons of Jacob Klee, Sen. (Senior), late of the township of Centre in said county of Berks deceased, preferred a Petition to the Judges of the Orphan's Court of the said county, setting forth, that the said Jacob Klee Senior, died on the 18th day of May, 1859, intestate, leaving a widow named Polly Klee and children to wit; Daniel Klee, Jacob Klee (the Petitioner), David Klee, John S. Klee, Abraham Klee, Elizabeth Klee, Sarah Bossler, married to Levi Bossler, late Sarah Klee, Caroline Seaman, wife of Lewis Seaman, late Caroline Klee, Rebecca Yoh, wife of Peter Yoh, late Rebecca Klee, and a following named children of Polly Seaman, late Polly Klee, deceased, viz. That the said descendents Jacob Klee Sen.: died seized in fee of in a certain tract of land situate in Centre Township, County aforesaid, containing twenty four acres,, more or less, ajoining lands of Jacob Klee Jr., Michael Staudt, and others, with the appertenances; and therefore praying the Court to award an inquest to view the same and make partition, &c., which was accordingly awarded by the Court. Therefore we command you, that you forthwith summon an inquest of twelve good and lawful men of your bailiwick, and go to the said premises, and then and there by their oaths and solemn affirmation make partition thereof, with the appertenances, to and among (blank spot) all the said children of the deceased, if the same can be done without prejudice to and spoiling the whole. But if the same cannot be so parted and divided without prejudice to and spoiling of the whole, that the same inquest do view and inquire whether the same will conveniently accommodate more than one of the said children – and if they so find, that they then ascertain and report how many the same will as aforesaid accommodate, describing each purpart by metes and bounds, and returning a just valuation and appraisement thereof. But if the said inquest shall find that the premises aforesaid, with the appertenances, cannot be parted and divided to and among (blank spot) all the children of the said deceased, nor accommodate more than one of the said children without prejudice to and spoiling of the whole, that they then value and appraise the same agreeably to law. That due and legal notice of the time and place of holding such inquisition be given to all the parties interested, that they may be present if they think proper. And that the petition or valuation so made, you distinctly and openly have, under your Hand and Seal, and under the Hands and Seals of those by whom the same shall be made, before our Judges at Reading, at our Orphan's Court, there to be holden the twenty fourth day of May next. Same day the Court grant and order of sale to Maria Klee, adminishatrix of said Jacob Klee dec'd (deceased) to sell said real estate of said real estate on the 19th day of October, 1860, at one o'clock on the premises. At an Orphans Court held at Reading in and for the County of Berks on the 24th day of May, AD one thousand eight hundred and sixty. Present: all the judges of said Courts. The Court grant a rule? Upon all the heirs and legal representatives of said Jacob Klee deceased and all persons interested to be and appear at an Orphans Court to be held at Reading in and for said County on the 20th day of September, AD 1860, at 10 o'clock a.m., then and there to accept or refuse the said real estate of said deceased at the valuation thereof or to bid more for the same, and in case the heirs, and legal representatives, and all persons interested in the estate of the said decedent there – to show cause, if any they have, why the same should not be sold according to law.

Pringle Jones, Esquire, President, and David Schall and George D. Stitzel, Esquires, associate judges of said courts. Whereas J. D. Bitting, High Sheriff of Berks County, made return of a certain writ of partition or valuation to him directed sur real estate of Jacob Klee, Sen (Senior), late of the township of Centre in the County of Berks, deceased, and which return and Inquisition at an Orphans Court held at Reading, in and for said County of Berks, on the 24th day of May, AD 1860. Present all the Judges. The Court on due consideration confirm the proceedings as returned and give judgments that the same be and remain firm and stable forever, and that the costs be paid by the parties concerned. Same day, appeared in open court, Daniel Klee, David Klee, Abraham Klee, Rebecca Yohe (Yoh on other pages) and Peter Yohe, Sarah Bossler, Caroline Seaman (Seaman), Elizabeth Klee, the minors Lewis Seaman (Seaman), William Seaman (Seaman), & Catherine Seaman (Seaman), by their guardian, and John S. That in pursuance of the said order of sale, she did on the 19th day of October, 1860, at 1 o'clock p.m. (the time named in said order), proceed to expose at public sale or outcry at the late residence of Jacob Klee, dec'd (deceased) in Centre Township in said county, the tract of land described in the announced? order of sale and then and there sold the same to Jacob Klee, Jr. for the sum one thousand two hundred and seventy three dollars and twenty one cents, $1273.21, he being the highest bidder and that the best price bidden for the said property, which sale so made as aforesaid, she prays may be confirmed to the said purchaser by the Court.

Know all men by these presents, that I, William Seaman (Seaman), of Bern Township, Berks County, Pennsylvania, having arrived at full age, do hereby acknowledge that I this day have had and received of my Guardian, John S. Klee, the sum of eighteen dollars and forty three cents, which sum is in full, dates faction and payment of my share or dividend of the estate, seal and personal of my Grandfather, Jacob Klee, late of Centre Township, count and state aforesaid, deceased; and by these presents, I do hereby release, acquit, and forever discharge the said John S. Klee, his heirs, executors, and Administrators, of and from the said Guardianship, and of and from the said dividends, shares and legacies, as well as from all actions, suits, payment accounts, claims, and demands whatsoever, for or by reason thereof, or the estate herein-before mentioned.

The petitions of Wellinton Yoh, George Yoh, Daniel Yoh, and Catharine Yoh, respectfully represents: that the petitioners are minor children above the age of fourteen years, of Peter Yoh and Rebecca Yoh. The said Rebecca Yoh being deceased and an heir of Jacob Klee, deceased, late of the County of Berks: that they have no person legally authorized to take care of their persons and estate, and they pray the Court that they may be permitted to make choice of a suitable person for that purpose. And they will ever pray, etc.
