Last Will and Testament of Ephraim Heckman

In the Name of God Amen, I Ephraim Heckman of the Township of Perry, County of Berks, and state of Pennsylvania, being of sound mind, memory and understanding. Do make and publish this my last Will and Testament, hereby revoking and making void all former wills by me at any time heretofore made.

And first; I order and direct that my body be decently interred in the cemetery according to the rites and ceremonies of the Church to which I am belonging at the time of my decease. And that my funeral be conducted in a manner corresponding with my Estate and situation in life. And I order and direct that my just debts and funereal expenses to be fully paid and satisfied by my Executor hereinafter named, as soon as conveniently may be after my decease.

Item 1st; I give and bequeath to my beloved wife Catharine Heckman, all such articles of my household goods and furniture and such consumable supplies as may be our hands at the time of my death, as she may choose to retain for her own use; and also the sum of two thousand dollars in money to be paid to her as soon as conveniently can be done after my decease, for the supply of her immediate wants, and also the interests during her natural life, of one third of all my real estate, after all my just-debts has been paid, which has to remain in lieu on the property as dower.

Item 2nd; I give and bequeath to my two daughters Sinda and Emma Heckman which are yet living with me. Each, the sum of one hundred and thirty-dollars, if they shall yet live with me at the time of my death. And if any of them shall not live with me at the time of my death the same shall not be entitled to the preference of the one hundred and thirty dollars. And in case Sinda should die before my decease her daughter Virgia Victoria Kershner, shall be the sole Heir of her share of my estate.

Item 3rd; All the rest residue and remainder of my estate real, personal and mixed whatsoever and wheresoever found I order and direct to be converted into money as soon as the same can conveniently be done after my decease. And for that purpose I do hereby authorize and empower my Executors hereinafter named and the survivor of them, to sell and dispose of all my real estate by Public or Private sale or sales for the best prices that can be gotten for the same, and by proper deed or deeds conveyance or assurance in the law, to be duly executed, acknowledged and perfected to grant and convey and assure the same to the purchaser or purchasers thereof.

Item 4th; All the rest and residue of any estate, whatsoever and wheresoever, of what nature, kind and quality soever the same may be. And not hereinbefore given and disposed of. I order and direct to be equally divided among my five children share and share alike.

Item 5th; I order and direct that if any of my heirs shall not be satisfied with my last will and testament and resort to any court of law or dispute the same, then such heir or heirs so resorting to law shall forfeit his, her or their share or shares of my estate heretofore directed as if such person or persons or were naturally dead and the forfeited part or parts to be divided among the rest of my heirs share and share alike.

Lastly; I constitute and appoint my wife Catharine Heckman and my son Noah Heckman to be Executors of this my last will and testament.

In witness whereof I Ephraim Heckman the testator have to this my last Will and Testament written on one sheet of paper, set my hand and seal this 11 day of June A.D. one thousand and eight hundred and ninety one.

Signed, sealed, published and declared, by the above names Ephraim Heckman, as and for his last will and testament in the presence of us, who have hereunto subscribed our names at his request as witnesses thereto in the presence of the testator and of each other.
