Last Will and Testament of Edward F. Woodward

Written in 1958; probated 12/31/1962

BE IT REMEMBERED, that I, Edward F. Woodward, single man of the Township of Robeson, County of Berks, and State of Pennsylvania, being of sound and disposing mind, memory and understanding, do make, publish and declare this my last will and testament, hereby revoking and declaring void any and all Wills and Testaments, or writings in the nature thereof, by me, at any time heretofore made.

FIRST: I order and direct the payment of all my just debts and funeral expenses by my hereinafter named Executors as soon as convenient after my decease.

SECOND: I give and bequeath the sum of ONE HUNDRED DOLLARS($100.00) to the trustees of HARMONY METHODIST CHURCH, in trust, the income therefrom to be used for the maintenance of the said church.

THIRD: In the event that BESSIE HOFFMAN is still in my employ at the time of my decease, I give and bequeath unto the said Bessie Hoffman the sum of ONE THOUSAND DOLLARS($1000.00). In the event she is not in my employ at the time of my decease, I give and beaueath the sum of FIVE HUNDRED DOLLARS($500.00) unto the said Bessie Hoffman. In the event the said Bessie Hoffman has predeceased me, then I direct that this bequest shall lapse and shall become part of the residue of my estate.

FOURTH: I order and direct that Emmerson Wade be given the first opportunity to purchase that portion of my real estate lying between the abandoned Pennsylvania Route No. 82 and the newly located Pennsylvania State Route No. 82 at the appraisal value.

FIFTH: I give and bequeath unto my brother, HARRY WOODWARD, the sum of ONE HUNDRED DOLLARS($100.00).

SIXTH: I give and bequeath unto my brother, WARREN WOODWARD, the sum of ONE HUNDRED DOLARS($100.00).

SEVENTH: I order and direct that any and all real estate, of which I die seized, be sold at public or private sale, and that the proceeds therefrom shall become part of the residue of my estate.

EIGHTH: I give and bequeath all the rest, residue and remainder of my estate in eight equal shares unto my sister, S. ANNA HOHL; my niece, GLADYS L. HEWITT; my niece, HAZEL C. SCHLAPPICH; my nephew, EARL L. HOHL; my niece, EVELYN N. UBIL; my nephew, ROBERT L. HOHL; my niece, ETHEL ANNA WEAVER; and my niece MARY EMMA ADAMS.

NINTH: Whereas, my niece ETHEL ANNA WEAVER and her husband, EARL WEAVER, are indebted to me in the sum of Two Hundred and Fifty($250.00), with interest unpaid for the last twelve years, I order and direct that said sum of Two Hundred Fifty Dollars($250.00) together with interest unpaid at the time of my decease, shall be charged against the distributive share of the said Ethel Anna Weaver in the residue of my estate.

TENTH: In the event of any of my aforesaid residuary legatees have predeceased me, leaving issue to survive him or her, then I give and bequeath the share or shares of the one or ones so dying unto his or her issue, such issue taking per stirpes. In default of issue, I order and direct that the share or shares of the one or ones so dying shall be distributed amongst the aforesaid residuary legatees living at the time of my decease, or his or her issue.

LASTLY, I nominate, constitute and appoint my nephews, EARL L. HOHL and ROBERT L. HOHL, Executors of this my last will and testament, and I further order and direct that each of them shall receive as compensation the sum of TWO HUNDRED FIFTY DOLLARS($250.00).

IN WITNESS WHEREOF, I, EDWARD F. WOODWARD, Testator of this my last will and testament written on three (3) sheets of paper, have hereunto set my hand and seal this___ day of____ Anno Domini, 1958.
