Last Will and Testament of David Oswaldt

Richmond Twp 1887

In the name of God, Amen. I, David Oswaldt, of the Township of RICHMOND, IN THE County of Berks and State of Pennsylvania, of the age of seventy five years being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare, this to be my Last Will and Testament. That is to say:

First, after all my lawful debts are paid and discharged, the residue of my estate, real and personal, I give, bequeath, and dispose of as follows. to wit;

First, that the property real or personal shall be divided equally among my heirs, with the exception that my son John shall have my clothes and $20.00 less than the others.

Second that it is my will that a tombstone shall be erected and to be paid out of the estate, and in case I should die in the year of 1886, Daniel, the executor shall rent the house with two gardens and ground for a potato patch, and the other to somebody else, or in case he can do so, for the term of one year and no longer. Likewise I make, constitute and appoint, my son Daniel, to be executor of this my last will and testament, hereby revoking all former wills and testaments by me made.

In witness whereof, I have hereunto subscribed my name, and affixed my seal, the twenty-seventh day of August in the year of our Lord one thousand eight hundred eighty six.

The above written instrument was subscribed by said David Oswaldt, in our presence, and acknowledged by him to each of us; and he at the same time published and declared the above instrument so subscribed, to be his last will and testament, and we, at the request and in his presence, have signed our names as witnesses hereto, and written opposite our names our respective place of residence.

On the 5th day of March A.D.1887. Before me personally appeared John Hartman and William H Rothermel the subscribing witnesses to the foregoing will, who being duly sworn according to law did dispose and say that they were present and did see and hear David Oswaldt testator sign seal publish and declare the forgoing instrument of writing as and for his last will and testament that at the time of so doing he was of sound mind memory and understanding to the best of their knowledge and belief.
