Last Will and Testament of Daniel Berger

I, Daniel Berger, of Upper Tulpehocken, Bern Township, Berks County, Pennsylvania, being of sound mind and memory, considering the uncertainty of life and being desirous to settle my worldly affairs, while I have strength and capacity, do make this my last will and testament, hereby revoking all former wills by me heretofore made.

I bequeath to my beloved wife, Elizabeth all my estate, real, personal, mixed, or of whatever nature it may be, to possess, and use it and have power with it, the same as we possessed and used it and have power with it during our joined lives, or the same as I would have power and use and possess it, during my life if I should survive her.

And further I constitute and appoint my beloved wife, Elizabeth my sole executrix of all my estate, real, personal, mixed or of whatever nature it may be, and give her power and authority to convey the same in her name to the purchaser or purchasers, if she desires to sell; to issue acknowledgements &c, in short, give her the same authority and power, as executrix as I would have if I would survive her.

In witness Whereof, I have hereunto subscribed my name and affixed my seal, the eleventh day of August, in the year of our Lord one thousand eight hundred and ninety four,

On the 16th day of February A.D. 1895. Before me personally appeared Emanuel Metz and Orlando F. Berger the subscribing witnesses to the foregoing Will of Daniel Berger deceased, and in their solemn oaths, did say that they were present, and did see and hear Daniel Berger deceased, the Testator therein named, sign, seal, publish and declare the same as and for his last will and testament, and that at the doing thereof he was of sound disposing mind memory and understanding, to the best of their knowledge and belief.

Unger who being duly sworn according to law, depose and say, that by the request of J H Weible (Executor) they will well and truly, and without prejudice or partiality, value and appraise the goods and chattels, rights and credits, which were of Daniel Berger deceased, and in all respects perform their duties as appraisers to the best of their skill and judgment.
