To All People to whom these Presents shall come Elisabeth Berger Widow and Administratrix of all and Singular the Goods & Chattels Rights and Credits which were of Christian Berger late of the Township of Bern in the County of Berks in the province of Pennsylvania Wheelwright deceased, at the time of his Death, who died intestate sendth Greeting. Whereas the said Christian Berger was in his Lifetime, by Virtue of some good Conveyances or Assurances in the Law duly had and executed lawfully seized in Fee Simple of and in A Certain Messuage or Tenement Plantation and Tract of Land situate in the Township of Bern aforesaid adjoining the Lands of Christian Albrecht, Henry Seidler, Jacob Staadt, Philip Hehn and others Containing by Estimation Two hundred and thirty four Acres or thereabouts, be the same more or less, with the Appurtenances Surveyed to the said Christian Berger by Virtue of two Several Proprietary Warrants one of them dated October 14th 1741 granted to Isaac Grigon ( ajes Reitzer) who granted the lands therein mentioned by deed of the 20th Nov 1746 unto George William Berger in Fee Who by Indorsement thereon dated May 7th 1752 granted the same to the said Christian Berger; And other of the said Warrants dated Sept 23rd.1747 granted to the said Christian Berger] and Whereas Upon the petition of the said Elisabeth Berger Administratrix as aforesaid to the Justices of the Orphans Court of the said County of Berks at an Orphans Court on ……………in the………….holden at Reading in and for the said County the twentieth Day of February last part, setting forth as therein is set forth, and praying the Court to grant her an Order to make Sale of the said Messuage or Tenement Plantation and Tract of Land with the Appurtenances for the payment of the Debts and Maintainance and Education of the minor Children of the said Intestate It was ordered by the said court that the said Petitioner should on Monday the twentieth Day of March then next expose the Premises aforesaid In Pursuance of which Order the said Elisabeth Berger Administratrix as aforesaid did on the day therein appointed expose the said Messuage or Tenement Plantation and Tract of Land to Sale by publick Vendue or Outcry whereof due Publick and timely notice was by her given according by Law and sold the same to Weyrich Mosser of the Township of Bern aforesaid Yeoman for the sum of Nine hundred and seventy pounds lawful money of Pennsylvania. He being the highest bidder and highest and best price bidden for the same Which Sale was, on Report thereof, confirmed by the said Court and ordered to be and remain firm and Stable for Ever as by the Records and Proceedings of the said Court Relation being thereunto had more fully appear. Now Know Ye that the said Elisabeth Berger for and in Consideration of the aforesaid Sum of Nine Hundred and Seventy Pounds Lawful Money aforesaid to her in Hand paid by the said Weyrich Mosser at and before the Ensealing and Delivery hereof the Receipt whereof is hereby acknowledged and the said Weyrich Mosser his heirs Executors and Administrators and forever discharged …………….. ……………. by these presents hath granted bargained sold released and confirmed and by these presents, by Virtue of the said recited Order of the Orphans Court doth grant bargain sell release and confirm unto the said Weyrich Mosser and to his heirs & assigns All that the aforementioned Land, or thereabouts, be the same more or less, Together with all and singular other the Buildings Improvements Ways Woods Waters Water Courses Rights Liberties Privileges Hereditaments and Appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions & Remainders Rents ………. And profits thereof and also all the Estate Right Title Interest Property Claim and Demand whatsoever of the said Christian Berger in his lifetime at and immediately before the Time of his decease of into or out of the Same To Have and to Hold the said, messuage or Tenement Plantation and Tract of two hundred and thirty four Acres of Land, or thereabouts, be the same more or less, Hereditaments and Premises hereby granted or mentioned or intended so to be with the Appurtenances unto the said Weyrich Mosser his Heirs and assigns forever Subject to the payment of proprietary Purchase Money Interest and Luit? Rent due and to become due for the same. In Witness whereof the said Elisabeth Berger hath hereunto set her Hand and Seal Dated the fifteenth Day of May in the Year of our Lord one thousand and seven hundred & seventy five. Elisabeth X Berger Sealed & Delivered in the presence of us Johannes Raugh, Collison Read. Berks County Be it remembered that on the fifteenth day of May Anno Dominic 1775 Before me the subscriber One of his Majesty’s Justices of the Peace of the County of Barks Came the within named Elisabeth Berger and acknowledged the within written Deed Poll to be her Act and Deed and desired the same might be recorded as such according to Law. Witness my Hand & Seal the day and year aforesaid.
