In re: Estate of Emanual Berger, late of Upper Tulpehocken Towhship, Berks County, Pennsylvania, deceased.

To the Honorable H. Willis Bland, President Judge of the Orphan's Court of Berks County.

The petition of George S. Berger and Benjamin S Berger, Administrators of the said Emanuel Berger, deceased, respectfully represents:

That the said decedent died intestate on the 23rd day of January, 1907; that the residence of the said decedent at the time of his death was in Upper Tulpehocken Township, Berks County, Penna.

That on the 16th day of February, 1907, letters of administrators of the said Emanual Berger were duly granted to your petitioners by the Register of Wills of Berks County.

That your petitioners make this application as administrators of the said Emanual Berger, deceased.

That the persons interested in the estate of the said Emanual Berger, deceased, are as follows:

(a) Parties interested under the intestate laws;
Christina Berger, widow
George S. Berger, son
Benjamin S. Berger, son
Henry S. Berger, son
Amos S. Berger, son
Kate Rutter, daughter
Sallie Feick, daughter
And Leanda Miller, an alleged daughter, thou the interest of the said Leanda Miller is as yet doubtful.

(b) Parties interested as creditors and the amounts due each;

That the real estate of which the decedent died seized in fee is as follows:

Purpart No.1. All that certain messauge, tenement and tract of land situate in Upper Tulpehocken Township, Berks County, Penna., adjoining lands of James Naftzinger, William Miller, Shomo Estate, Enoch Hiester, H. J. Daub, Frank H. Stump, John H. Hollenbach and Charles Rentschler Estate, Containing One hundred and fifty-two acres and thirty-nine perches, more or less. (152 A. 39 P.)

Purpart No. 2, All that certain messuage, tenement and tract of land situate in Upper Tulpehocken Township, Berks County, Penna., adjoining lands of Daniel Kline Estate, Charles Bauscher, Daniel Bauscher, Robert Kline, Benjamin Wagner and the Estate of Charles Rentschler, Containing One hundred and forty-five acres and one hundred and forty-two perches. (145 A. 142 P)

Purpart No. 3, All that certain tract of woodland situate in Upper Tulpehocken Township, Berks County, Penna., adjoining lands late of Jonathan Goodman, John Himmelberger, Jacob Pottieger and others Containing Fifty-six acres and 100 perches.

That the appraised value of the said real estate is as follows: No. 1, at $5412.00, No. 2, at $2117.50 No.3, at $224.00 Total $8053.50

That the decedent left personal property appraised at $472.85 as is certified by the Register of Berks County, which said certificate is hereto attached.

That the personal property is not sufficient to pay the just debts of the said decedent.

Your petitioners therefore pray your Honorable Court to grant to them an order authorizing them to make sale of the above described real estate in accordance with the Act of Assembly and Rules of Court for the payment of debts.

And your petitioners will ever pray etc.
